Birth Injury

Cerebral palsy, brain damage, paralysis, and other birth injuries

When preventable birth injuries create long-lasting damage, medical expenses can be enormous. Most people need legal help to gain compensation for the high cost of medical care.

Greg Jones & Associates represents clients nationwide in a variety of birth injury cases, such as:

Cerebral palsy

Cerebral palsy results in body movement and muscle coordination disorders. The underlying cause of cerebral palsy is brain damage. Cerebral palsy usually becomes noticeable during the first few years of life, and while permanent, it does not worsen as time goes on and sometimes improves.

There are different types of cerebral palsy with characteristics such as stiff or labored mobility, balance and depth perception loss, involuntary movements, or a combination of these disorders.

Shoulder dystocia

Shoulder dystocia is a delivery complication where the baby’s shoulder becomes lodged behind the mother’s pelvic bone. Improper birthing may damage nerves in the baby’s arm and shoulder, resulting in short or long-term paralysis, also called palsy. Different types of paralysis resulting from shoulder dystocia include Erb’s palsy, brachial plexus palsy, and Klumpke’s palsy.

Brachial plexus palsy

Brachial plexus is the name for the bundle of nerves in the shoulder area that affects the shoulder, arm, and hand. Brachial plexus palsy is a paralysis of the shoulder, arm, and hand, often observable as a weak arm and hand.

Erb’s palsy

Erb’s palsy is a specific type of brachial plexus palsy that only affects the shoulder and upper arm.

Klumpke’s palsy

Klumpke’s palsy is also a specific type of brachial plexus palsy. However, it causes paralysis in the lower arm, wrist, and hand.

Birth injury medical malpractice

Doctors and medical specialists become liable when preventable errors result in severe birth injury. Such errors may include:

  • Failure to perform a timely C-section
  • Failure to evaluate risks of a narrow birth canal
  • Excessive pressure using forceps
  • Improper use of vacuum extractors
  • Improper or lack of prenatal care
  • Failure to detect baby distress
  • Failure to monitor or properly treat a baby after birth
