Birth Injury Laws

If your child has suffered a birth injury due to the negligence or malpractice of a health professional, your family needs the help of an attorney who understands the complex web of birth injury laws that apply to your situation. A malpractice action may be brought in certain cases. The lawyers of Greg Jones & Associates have years of experience with birth injury law and fight to protect your injured infant. We work to secure compensation to care for and to treat your baby to the full extent possible under birth injury laws.

Birth injury causes

A difficult birth or injury to the baby can occur because of the size or position of the baby during labor and delivery. Conditions that may be associated with a difficult birth include, but are not limited to, the following:

  • Large babies
  • Prematurity
  • Cephalopelvic disproportion - the size and shape of the pelvis of the mother is not adequate for the baby to be born vaginally
  • Dystocia—difficult labor or childbirth
  • Prolonged labor
  • Abnormal birthing presentation such as breech
  • Oxygen deprivation

Common birth injuries

Common birth injuries include the following:

  • Caput succedaneum—a severe swelling of the soft tissues of the baby's scalp that develops as the baby travels through the birth canal
  • Brachial palsy—occurs when the brachial plexus (the group of nerves that supplies the arms and hands) is injured and is most common when there is difficulty delivering the shoulder of the baby, called shoulder dystocia
  • Klumpke’s palsy
  • Cerebral palsy
  • Subconjunctival hemorrhage—the breakage of small blood vessels in the eyes of a baby
  • Fractures—fracture of the clavicle or collarbone is the most common fracture during labor and delivery.
  • Erbs palsy

Greg Jones & Associates handle birth injury cases throughout the United States. If your child was injured during birth, and you have reason to believe there were difficulties during the birthing process, we can review and evaluate your case at no charge to see if the injury was caused by the negligence or malpractice of a healthcare professional. The most common causes of cerebral palsy include negligent prenatal care by a doctor or by a mistake in the delivery room.
